Dynasty vs. Non-Dynasty Trusts Pros & Cons – A Panel Discussion
CEPC (Chicago Estate Planning Council)
Louis S. Harrison
Long-term trusts popularly known as “dynasty trusts” have been on the rise as an estate planning tool for families to pass on wealth for many generations to come, perhaps even perpetually. This panel will address the reasons for the popularity of the dynasty trust but also the issues that have arisen as existing dynasty trusts have been unfolding over the years. In addition, the panelists will discuss:
Planning tips, such as building in flexibility into the trust instrument, “fixing” existing dynasty trusts, and avoiding the “trust fund babies” phenomenon;
Federal and state income taxation and other tax considerations, including the “Delaware Tax Trap”; and
What we may anticipate seeing as the future of the dynasty trust.
